OVERVIEW

Litigious practices are often unnecessary and usually create further harm, relationship breakdowns and unsustainable expenses. 

Mediation is focused on creating win-win outcomes for all stakeholders in a collaborative solutions oriented approach. 

Mediation allows for a creative and fluid approach to conflict resolution that maintains or improves relationships and structures

At Heron Resolutions, mediation can include one on one, group mediations or alternative formats to best fit the needs of the individuals.

Whether you require mediation ahead of entering a complaint process or are trying to work through a conflict without escalating it, we can design a mediation process that works for you. 

At Heron Resolutions, we provide in person and/or virtual mediations. All mediations are approached with the understanding that parties may have experienced significant harm ahead of entering the mediation room. Wherever possible, we work to include the necessary support people and practices. 

We will provide efficient, tailored mediation and Alternative Dispute Resolution processes to fit the needs of the parties and/or the organization. Heron Resolutions offers many variations of mediations, including ‘in-writing’ mediations, shuttle mediations and mediations that incorporate the cultural and social norms of the parties. 

THE PROCESS

Mediation, when compared to Arbitration or a complaint pathway, is a consent-based process where the impacted parties work towards a satisfactory resolution. 

Stage 1: Consultation: 

  1. Typically, the mediation will involve a brief consultation to determine the format, fees, and necessary stakeholders to the mediation.  
  2. The mediator will assess if the parties are ready for mediation and if the conflict is appropriate for mediation / Alternative Dispute Resolution. 

Stage 2: Pre-Mediation: 

  1. Following the consultation, parties will engage in a pre-mediation session to discuss positions, interests and priorities.  
  2. We will discuss sensitive information and boundaries in the process, to ensure all parties feel prepared and informed.
  3. Parties will sign a mediation agreement that outlines the mediation process, expectations and confidentiality. 

Stage 3: Mediation: 

  1. In the mediation, which can occur in person, or online, we will support the parties in determining if a resolution is possible. 
  2. Should the parties come to a resolution, we will support drafting of the agreement. 
  3. In the rare circumstances where resolution is not possible, we will support the parties in determining the appropriate pathways are for moving forward.
